New Jersey launches civil rights initiative targeting AI-related discrimination

Attorney General Matthew J. Platkin and the New Jersey Division on Civil Rights (DCR) have announced a new initiative focused on addressing discrimination linked to artificial intelligence (AI) and advanced technologies. This initiative includes the launch of a Civil Rights Innovation Lab aimed at preventing bias-based harassment and fostering innovation through public guidance on how these technologies align with the New Jersey Law Against Discrimination (LAD).

A newly published guidance document explains how LAD applies to algorithmic discrimination, providing examples and detailing how AI can lead to bias. The document clarifies that entities using AI could face liability for discriminatory outcomes if tools are not properly managed.

The Civil Rights Innovation Lab will work with experts to develop technology enhancing DCR's enforcement, outreach, and education efforts. Governor Phil Murphy emphasized the dual nature of AI in detecting discrimination while also posing risks of misuse. He stated, “The Division’s legal guidance will help companies ensure that their own uses of AI comply with the law.”

Attorney General Platkin highlighted the importance of considering diverse community needs when deploying new technologies, noting, “Our office will continue to support responsible innovation in New Jersey.”

Sundeep Iyer, Director of DCR, explained the lab's role in supporting responsible innovation while addressing discrimination risks: “We look forward to working with all New Jerseyans to ensure that innovative new technologies are deployed responsibly.”

Dr. Beth Simone Noveck, State Chief AI Strategist, praised the initiative as a demonstration of New Jersey's leadership in leveraging emerging technology for public benefit.

The issued guidance outlines potential discriminatory practices linked to automated decision-making tools across various sectors such as employment and housing. It stresses careful design and evaluation to avoid unlawful discrimination.

An upcoming virtual program titled "Innovating Fairness: Launch of the Division on Civil Rights’ Innovation Lab" is scheduled for January 16. Additional training sessions on bias from AI usage will be offered later this year.

The initiative builds on previous efforts by DCR to tackle algorithmic discrimination, including proposed regulations concerning disparate impact liability related to automated decision-making tools in employment.
