The former New Jersey State Police trooper, Nicolas Hogan, was sentenced for assaulting a handcuffed woman in September 2022. The incident occurred in Cumberland County when Hogan punched the victim while holding a metal flashlight. The sentencing took place on September 30, 2024, by Judge Joseph M. Chiarello in New Jersey Superior Court.
Hogan, 28, from Gibbstown, New Jersey, received a sentence of two years probation with up to 364 days in county jail. However, the jail term was suspended. He is also permanently banned from future public employment. Hogan had been suspended without pay since November 2023 and was terminated by the State Police in September 2024.
Attorney General Matthew J. Platkin stated that this act of violence was unjustified as the victim was already detained and handcuffed. "This incident is not a reflection of the character or professionalism of the many dedicated members of the State Police," he added.
Drew Skinner, Executive Director of OPIA, emphasized that law enforcement's improper use of force is unacceptable and highlighted that "no one is above the law."
Hogan pleaded guilty on July 25, 2024, to aggravated assault (3rd degree). The assault happened on September 7, 2022, in Upper Deerfield Township while waiting for medical personnel to evaluate the victim.
NJSP troopers responded to a trespassing report at around 1:30 a.m., identifying the victim walking on the road. Though she was not under arrest but detained for evaluation, she became distraught and resisted detainment. After being handcuffed and placed in a police vehicle where she spat towards troopers multiple times, Hogan reacted by punching her.
The case was prosecuted by Deputy Attorneys General Brian Uzdavinis and Niccole Sandora under OPIA's supervision.
