State Grand Jury Declines to Criminally Charge Officer in Connection with Fatal Police-Involved Shooting in Elizabeth on July 29, 2023

A state grand jury has decided not to file any criminal charges in relation to the fatal shooting of Estiben Alegria-Hurtado, 42, by an officer from the Elizabeth Police Department on July 29, 2023.

The decision was reached after thorough investigations and presentations to New Jersey residents serving on the grand jury, in accordance with the Independent Prosecutor Directive of 2019. The Office of Public Integrity and Accountability (OPIA) oversaw the investigation, ensuring a neutral and transparent process.

"After hearing the testimony and evidence, the jurors deliberated on March 18, 2024, and voted ‘no bill,’ concluding that no criminal charges should be filed against Officer Steven Lazo," stated the official report.

The incident occurred on July 29, 2023, when officers responded to a 911 call at a residence in Elizabeth. A confrontation ensued, leading to Officer Lazo discharging his firearm, fatally shooting Mr. Alegria-Hurtado, who was in possession of a knife.

Mr. Alegria-Hurtado's death was thoroughly investigated, including the review of various evidence such as witness interviews, surveillance footage, ballistics results, and autopsy findings. The grand jury carefully considered all the information before reaching its decision.

In compliance with legal procedures, the Attorney General's Office conducted a comprehensive investigation into the incident, presenting all findings to the grand jury for evaluation.

The Independent Prosecutor Directive and the standard operating procedures were followed diligently to ensure transparency and fairness throughout the process.

The investigation concluded that Officer Lazo's actions were not deemed criminally chargeable, with the grand jury considering all elements, including self-defense and legal justifications.

The Office of Public Integrity and Accountability will now oversee any administrative review that may be necessary, ensuring that appropriate actions are taken based on the results of the investigation.
