Attorney General Matthew J. Platkin announced that he is leading a coalition of 14 states in a legal effort to defend health insurance access for DACA recipients, often referred to as Dreamers. This move comes amid concerns that the incoming Trump Administration might cease defending the U.S. Department of Health and Human Services (HHS) and Centers for Medicaid and Medicare Services (CMS) Final Rule, which allows DACA recipients to access Affordable Care Act (ACA) exchanges.

Platkin stated, "I have proudly led the fight for DACA for years, and now I’m proud to lead the effort ensuring that Dreamers have the same access to healthcare as everyone else." He emphasized New Jersey's commitment to opposing efforts by President-elect Trump to roll back protections for Dreamers, highlighting their importance to both the community and economy.

Governor Murphy expressed support by stating, “New Jersey’s Dreamers make our state strong and vibrant and they should not be deprived of access to basic health care services.” Similarly, New Jersey Department of Human Services Commissioner Sarah Adelman commended Governor Murphy and Attorney General Platkin's proactive stance in protecting DACA recipients' right to healthcare.

The Final Rule issued last year by the Biden Administration sought to expand ACA exchange eligibility for Dreamers. However, a lawsuit filed in North Dakota challenges this rule, with some states currently blocked from implementing it. Nonetheless, it remains effective in New Jersey where DACA recipients can continue using Get Covered New Jersey.

Commissioner Justin Zimmerman from the New Jersey Department of Banking and Insurance highlighted state efforts through Get Covered New Jersey in providing affordable coverage options including for DACA recipients. Health Commissioner Kaitlan Baston also underscored how allowing Dreamers access to ACA exchanges benefits public health systems overall.

DACA was established in 2012 permitting eligible individuals who arrived in the U.S. as children temporary protection from deportation along with work authorization under deferred action status. Despite these provisions allowing residence and employment within America legally present regulations previously excluded them from accessing ACA marketplaces until recent changes were introduced through federal policy updates initiated by President Biden's administration but contested legally afterward.
