Attorney General investigates inmate's death at Northern State Prison

The Attorney General’s Office of Public Integrity and Accountability (OPIA) is conducting an investigation into the death of an inmate from Northern State Prison in Newark. The inmate, identified as David Silva, aged 46, died following an encounter with correctional police officers on December 3, 2024. Silva was pronounced dead at a hospital on December 12, 2024. The names of the officers involved have not been disclosed.

Currently, the investigation remains active, and no additional information has been provided.

According to a law enacted in 2019, N.J.S.A. 52:17B-107(a)(2), it is mandatory for the Attorney General’s Office to investigate any deaths that occur during interactions with law enforcement officers acting in their official capacity or while the deceased is in custody. This law also mandates that such investigations be presented to a grand jury to assess whether there is sufficient evidence to indict the officer or officers involved.
