TRENTON — A state grand jury has voted "no bill" at the conclusion of its deliberations regarding the death of Bernard Placide, 22, of Englewood, New Jersey, who was fatally shot by an Englewood police officer on September 3, 2022.
The investigation into Mr. Placide’s death was conducted by the Office of Public Integrity and Accountability (OPIA) and presented to New Jersey residents serving on the grand jury in accordance with the Independent Prosecutor Directive of 2019. The grand jury voted not to file any criminal charges against Englewood Police Officer Luana Sharpe.
According to the investigation, officers responded to a violent domestic disturbance call where Mr. Placide was found holding a knife. Despite orders to drop the weapon and deployment of a taser, Mr. Placide did not comply, leading to Officer Sharpe discharging her firearm and fatally striking him.
The three civilians injured before officers arrived were treated and released from the hospital, while Officer Sharpe was treated for an injury to her hand from the knife.
The Attorney General’s Office conducted the investigation as required by law, and the evidence was presented to the grand jury to determine if criminal charges were warranted. The Independent Prosecutor Directive ensures a thorough and transparent process in such cases.
The grand jury's decision not to file charges aligns with the legal framework surrounding investigations of deaths during encounters with law enforcement officers. The investigation was conducted following standard procedures to maintain objectivity and transparency.
The details of the incident, including witness interviews, video footage, and autopsy results, were thoroughly reviewed before the grand jury's conclusion. The decision highlights the complexities and challenges faced by law enforcement officers in high-pressure situations.
The Independent Prosecutor Directive and OPIA’s standard operating procedures for grand jury presentations ensure accountability and oversight in cases involving fatal police encounters. The process aims to uphold justice and transparency in law enforcement actions.
