Senator Declan O’Scanlon introduced legislation on Apr. 14 that aims to clarify the School Ethics Act cannot be used to limit or prohibit school board members from speaking publicly, including on social media, about matters of public concern.

He emphasized that his legislation is intended to ensure these officials retain their First Amendment rights: “My legislation makes it clear that school board members do not surrender their First Amendment rights when they take office. In fact, we’d be better off if more elected officials engaged with their constituents without fear of crossing some vague or overreaching line.”
